Examination and Approval of Establishment of a Certification Consultant Agency

2 Legal Basis
(1) Decision of the State Council on the establishment of Administrative Licensing for Items Subject to Administrative Examination and Approval which Need to Be Retained (Order No. 415 of the State Council)
(2) Rules on Registration and Supervision of a Certification Agency and on Examination and Approval of Certification Training and a Consultant Agency issued jointly by the Certification Accreditation Administration of the People's Republic of China, the General Administration of Quality Supervision, Inspection and Quarantine, and the State Administration for Industry and Commerce and former Ministry of Foreign Trade and Economic Cooperation (Joint Issuance No. 21 (2002) of the Certification Accreditation Administration of the People's Republic of China)

3 Conditions for Application
(1) In an application for the establishment of a certification consultant agency the applicant shall:
(a) have a fixed-address location and the necessary facilities;
(b) have management documentation in conformity with the requirements of certification accreditation;
(c) have a registered capital of no less than 500,000 RMB;
(d) have at least 5 certification consultants duly qualified in relevant fields including 2 senior consultants and 3 junior consultants.

(2) In an application for the establishment of a branch office, the applicant shall:
(a) have a fixed-address location and office equipment;
(b)have at least 2 specific certification consultants duly qualified in relevant fields including 1 advanced senior consultant and 1 junior consultant.
(c) have management documentation in conformity with the requirements of certification accreditation
(3) In an application for expansion of business scope, the applicant shall:
(a) hold an 4-year approval;
(b) have at least one specific consultant duly qualified in relevant fields;
(c) have management documentation in relevant fields.

(4) to establish an office location record, the applicant shall:
(a)have a fixed-address location and office equipment invested in by the applicant;
(b) have full-time staff employed by the applicant;
(c) have management documentation in conformity with the requirements of certification accreditation.

4 Implementing Organizations
Authority initially dealing with application: the Shanghai Bureau of Quality and Technical Supervision (hereinafter referred to as the Bureau)
Authority approving application: Certification Accreditation Administration of the People's Republic of China (hereinafter referred to as CNAT).

5 Procedures
(1) Application and Acceptance

(A)An Applicant shall submit the application and the supporting materials below to the Bureau:
For establishment of a new consultant agency, the following documentation shall be submitted:
(a) Application for Establishment of Certification of a Consultant Agency (see Annex 1) in duplicate;
(b) Certificates for registered capital;
(c) Identification certificate of legal representative to be appointed;
(d) Pre-authorizing Notice of the Enterprise Name Registration;
(e) Certificates proving the use of business operation sites;
(f) Documents showing a quality management system (both a quality manual and procedural manual);
(g) Name list, identification certificates and registered certificates of competency of chief executive officers and full-time staff to be employed (in the case of staff not certified by CNAT,a confirmation document issued by CNATshall be provided);
(h) The level and purpose of fees for certification consultation to be implemented;
(i) Commitment to observe national laws, regulations and rules after approval;
(j) Commitment of veracity, completeness and accuracy of information and materials provided.
For expansion of business scope, the following documentation shall be submitted:
(a) Application for Item Expansion of a Certification Consultant Agency (see Annex 2) in duplicate;
(b) Approval of Certification Consultant Agency (copy);
(c) Name list of full-time personnel applying for item expansion, statement confirming full-time status (original) and copy of certificate of competency;
(d) System document on relevant fields of items which expansion is applied for;
(e) Commitment of veracity, completeness and accuracy of materials provided

(B)The Bureau shall examine the application materials and make a decision on acceptance or rejection of the application within 5 days, and issue a written notice to the applicant.

(C)The Bureau shall send the application materials to CNAT by post or by a designated person after the materials have been approved. The Bureau shall give recommendations and affix its official stamp.

(2) Examination and Determination
(A) Two staff members of the Department of Accreditation Supervision in CNAT shall examine the application materials within 10 working days according to the Key Points for Examination and Approval of Establishment of a New Certification Consultant Agency.

(B)Where the application materials do not meet relevant requirements, the Department of Accreditation Supervision shall send a Form on Existing Issues in the Application Materials for Certification of a Consultant Agency (see Annex 3) to the Bureau, which shall forward the Form to the applicant.

(C) In case supplementary materials submitted by the applicant still do not meet relevant requirements, the Department of Accreditation Supervision shall notify the Bureau which shall forward this information to the applicant. The applicant may reapply (application materials will not be returned) if desired.
(D)Where the application materials meet relevant requirements, relevant information about the certification agency to be established and its staff, or about the sought expansion of an agency’s business scope, shall be published on the website of CNAT for 30 days. Following that period, an expert panel shall be established if no objection was raised during the period of publication. The panel shall examine the documents and, if necessary, any related websites, for a further 30 days.
(E) CNAT shall make the following decisions according to the opinions of the expert panel within 10 working days:
(a) Approval. For the establishment of a new certification consultant agency, the Department of Accreditation Supervision shall send the Notice of Approval of Establishment of a Certification Consultant Agency (see Annex 4) to the Bureau,which shall forward the notice to the applicant. For approval of an expansion of business scope, the Department of Accreditation Supervision shall send the Approval for Certification of a Consultant Agency (see Annex 5) to the Bureau.

(b) Rejection. The Department of Accreditation Supervision shall notify the Bureau which shall notify the applicant.
(3) Issuing Certificate
(A) Establishment of a new agency: The applicant shall finish the enterprise registration. CNAT, upon receiving a copy of a business license verified by the Bureau, shall send the Approval for Certification of a Consultant Agency to the Bureau, which shall forward the Approval to the applicant.
(B) Expansion of business scope: The applicant may draw a new Approval for Certification of a Consultant Agency from the Bureau based on its former Approval for Certification of a Consultant Agency.
(4) Renewal of Administrative Licensing
A Licensee shall submit an application 30 days before the expiration date of its current administrative licensing to renew the licensing.

6 Time Limits
(1) The Bureau shall finish the first examination within 20 working days from the date of acceptance of the application;
(2) CNAT shall make a decision on approval or rejection within 20 days from the date of receiving the application materials (the 30 days for publishing application materials and 30 days for panel examination are excluded).

7 Fee
No fee will be charged for the licensing process.
