Examination and Approval of Establishment of a Certification Consultant Agency

2 Legal Basis
(1) Decision of the State Council on the establishment of Administrative Licensing for Items Subject to Administrative Examination and Approval which Need to Be Retained (Order No. 415 of the State Council)
(2) Rules on Registration and Supervision of a Certification Agency and on Examination and Approval of Certification Training and a Consultant Agency issued jointly by the Certification Accreditation Administration of the People's Republic of China, the General Administration of Quality Supervision, Inspection and Quarantine, and the State Administration for Industry and Commerce and former Ministry of Foreign Trade and Economic Cooperation (Joint Issuance No. 21 (2002) of the Certification Accreditation Administration of the People's Republic of China)

3 Conditions for Application
(1) In an application for the establishment of a certification consultant agency the applicant shall:
(a) have a fixed-address location and the necessary facilities;
(b) have management documentation in conformity with the requirements of certification accreditation;
(c) have a registered capital of no less than 500,000 RMB;
(d) have at least 5 certification consultants duly qualified in relevant fields including 2 senior consultants and 3 junior consultants.

(2) In an application for the establishment of a branch office, the applicant shall:
(a) have a fixed-address location and office equipment;
(b)have at least 2 specific certification consultants duly qualified in relevant fields including 1 advanced senior consultant and 1 junior consultant.
(c) have management documentation in conformity with the requirements of certification accreditation
(3) In an application for expansion of business scope, the applicant shall:
(a) hold an 4-year approval;
(b) have at least one specific consultant duly qualified in relevant fields;
(c) have management documentation in relevant fields.

(4) to establish an office location record, the applicant shall:
(a)have a fixed-address location and office equipment invested in by the applicant;
(b) have full-time staff employed by the applicant;
(c) have management documentation in conformity with the requirements of certification accreditation.

4 Implementing Organizations
Authority initially dealing with application: the Shanghai Bureau of Quality and Technical Supervision (hereinafter referred to as the Bureau)
Authority approving application: Certification Accreditation Administration of the People's Republic of China (hereinafter referred to as CNAT).
